Terms of service

These terms and conditions shall apply to all orders for goods received by Turmeric merchant. No other conditions whether or not inconsistent with these conditions shall apply. It is very important that you read and understand them. These conditions do not affect your statutory rights. Acceptance of Orders 
All orders are accepted by Turmeric merchant subject to these conditions of sale. No variation of these conditions will be accepted unless previously agreed in writing by the Managing Director of Turmeric merchant. Orders will only be binding upon receipt of written confirmation from Turmeric merchant, who reserves the right to refuse any order. In the event of any pricing error occurring within this website, within any fax or e-mail correspondence however received, all incomplete orders shall be deemed void.

Customer’s Authority 
Customers entering into transactions with Turmeric merchant expressly warrant that they are authorised to accept and are accepting these conditions not only for themselves but also as agents for and on behalf of all other persons who are, or may become, interested in Turmeric merchant’s goods or products, whether in whole or part.

Payment 
We accept online payment through Shopify, Amazon Pay, Apple Pay and Paypal. We do not store credit card details nor do we share customer details with any 3rd parties. If you are shopping from outside the Euro zone, place your order and your credit card company or bank will convert the transaction to your own currency. Payments can be accepted in Sterling Pounds. Trade / Wholesale customers may pay by credit/debit cards only at time of placing an order. Trade / Wholesale customers can apply for a credit limit, Turmeric merchant will assess your company details and provide you with the appropriate credit limit and time based on trading history. Otherwise invoices must be paid by credit card at the time of purchasing. All orders for goods are subject to stock availability. If we do not supply goods to you for any reason, we will inform you of the situation and will not charge you for those goods, and will refund any money already paid by you for these goods. We are not liable for any financial loss incurred by you relating to interest payments, or loss of earnings, or similar gains you would have received on monies paid to us in lieu of an un-fulfilled order.

Prices 
All prices quoted or displayed are in GB Pounds at the time your order is placed. We are entitled to make adjustments to the price to take account of any increase in, or the imposition of new taxes or duties. If due to an error or omission the price published for the goods on our website is wrong, we have the right to terminate an order provided the goods have not been dispatched. We will try to ensure that all prices displayed on our website are accurate, but should an error occur, we would inform you of the correct price and give you an opportunity to cancel the order. Please note that the prices quoted are subject to availability and Turmeric merchant reserves the rights to refund the payments to you if the database processes your order in error. Every effort will be made to maintain a stable supply and pricing policy subject to market conditions and variations. Turmeric merchant reserves the right to alter prices without notice explanation or notification. We will be pleased to confirm our latest prices by telephone.

Product Details and Specifications 
Care has been taken to convey the exact details and specifications of the products. Turmeric merchant reserves the right to alter details and specifications without notice explanation or notification. Some photographs / graphics on the website are for graphical purposes only and may not be of Turmeric merchant foods itself.

Retention of Title 
All goods supplied by Turmeric merchant to the customer shall remain the property of Turmeric merchant until such time as Turmeric merchant receives payment in full for the goods and of all other monies due to Turmeric merchant from the customer. Until such payment as aforesaid is received, the separate identity of those goods shall be maintained by the customer. After delivery of the goods to the customer or his nominated sub-purchaser, the goods shall be at the customer’s risk and the customer shall insure those goods against loss or damage.

Until such time as title in the goods shall pass to the customer in accordance with the foregoing provisions, Turmeric merchant shall be entitled at any time to repossess the goods whether with or without notice and Turmeric merchant and its employees or agents shall have the right at any time to enter upon the premises of the customer for the purpose of effecting such repossession.

Force Majeure 
Turmeric merchant will not be liable to you for any failure or delay in performance of our contract, if it is due to an event beyond our reasonable control including, without limitation, acts of God, war, industrial dispute, fire, flood, tempest and national emergencies and if so delayed we shall be entitled to a reasonable extension of time for performing such obligations.

No Warranty 
Goods are supplied according to the descriptions and specifications given by the manufacturer. Turmeric merchant and its employees or agents are not authorised to make any representations concerning the goods unless strictly confirmed in writing. In entering into this agreement you acknowledge that you do not rely on any such representation to complete your purchase with us. We make no warranty as the suitability of any goods for any particular purpose. Health Foods are not medicines, thus Turmeric merchant cannot and are not authorised to guarantee results. In entering into this agreement you acknowledge that there are no guarantees for the purpose of the goods.

Proper Law 
All contracts made with Turmeric merchant shall be governed by and construed according to the English Law and the purchaser submits to the jurisdiction of the English courts. These terms of trade will prevail over any conditions that shall be issued by the customer. The customer should not rely on any representations made by staff as they do not form part of the contract or collateral contract.

Promotions 
Multiple promotions/offers cannot be combined on a single order.

Any typographical, clerical other omissions or errors however made, in any of Turmeric merchant’s literature, quotations, price lists, invoices or any other documents or information supplied by the company shall be subject to correction without any liability on the company’s part.
